Parliament Votes to Maintain Term Limits in the Constitution but Introduces an Inconsistent Article 172

The Democratic Green Party of Rwanda takes note of today s (29/10/2015) vote by the Rwandan Parliament on the draft constitution and especially on Article 101, regarding term limits. It’s good that the Parliament took notice of our request and accepted to reduce the term limits from 7 years to 5 years and also to maintain the term limits. This is a big victory on one hand and we congratulate them for that action. We are, however, surprised on the other-hand by the introduction of the new Article (172). This seems to be inconsistent with Article 101 and the spirit of the constitution. The Democratic Green Party of Rwanda takes on this opportunity to request the Rwandan Senate to scrutinize this draft, remove the inconsistency and make appropriate changes before submitting the final draft for the referendum. On Saturday, 17th October 2015, the Democratic Green Party of Rwanda, successfully trained its political bureau members on participatory democracy, human rights and elections at Hotel Le Printemps in Kigali. The party leaders, had an opportunity to be refreshed on both national and international protocols and practices on human rights, democracy and elections. Members were also trained on their role in the promotion of free and fair elections, promotion of human rights in Rwanda and their active involvement in participatory democracy. The Party also awarded certificates to 24 graduates of the Youth Political Leadership Academy. The party also held a political bureau meeting and a press conference and demands the following: The National Electoral Commission to consider programming the No Change campaign in case a referendum is confirmed for the change of the constitution and plan for that budget from the tax payer’s money, since the parliamentarians have already conducted a sensitisation campaign for the change of the constitution using public funding. Government to separate roles of public servants from those of heading political organisations at district and local levels. It’s been a culture, where all District Mayors and Local leaders, automatically become Chairpersons of the ruling party in all the administrative areas of the country. DGPR finds this a big conflict of interest and betrayal of the trust of the voters, since all those leaders were not elected on a party ticket. This bad culture must stop and come into effect after the February/March 2016 local elections. The National Public Prosecution Authority should take over from the National Police the dossier of the Party’s National Organising Secretary, Jean Damascene MUNYESHYAKA, who went missing on 27th June 2014 in Bugesera District. The National Public Prosecution authority is requested to finalise those investigations, and let the public know whether, Mr.Munyeshyaka is still alive or already dead. DGPR calls upon all local authorities to embrace a democratic culture and stop mistreatment of party members at all local levels. Rwanda Supreme Court Rules to Change the Constitution: DGPR will hold a No Change Campaign

Today, the 8th of October 2015, Rwanda’s Supreme Court, chaired by the Chief Justice, Prof.Sam RUGEGE, ruled in favour of changing the constitution in the case submitted by the Democratic Green Party of Rwanda, vs the Government of Rwanda, regarding the non-lifting of Presidential Term Limits from the Constitution. According to Article 98 of the Rwandan Constitution, the President of the Republic is the Guardian of the Constitution and guarantor of national unity. The Democratic Green Party of Rwanda, will therefore, appeal to the President of the Republic to ensure the non-lifting of Presidential Term limits in the constitution. The Democratic Green Party of Rwanda will also conduct a No Change campaign nationwide, sensitising Rwandans not to vote for the change of the constitution, in case of a national referendum. The Party will also explore other legal procedures like filing a case in the African Court on Human and Peoples Rights as well as the East African Court of Justice.
