Almost five years ago, the Parliament enacted a law regulating labour in Rwanda. This important legislation left key minimum wage provision details at the discretion of the Minister in Charge of Labour to determine – but it has not yet been set. The effects of this situation are far-reaching; from employees’ welfare as some get small pay that does not match the current high cost of living, to the controversies in compensation payments for accident victims by insurers, among others, according to some lawmakers, labour unions and insurance firms. ALSO READ: Labour law passed without setting new minimum wage Going forward, in order to avoid the recurrence of a similar situation, some lawmakers told The New Times that Parliament should adopt a practice by which both the bills and their implementing orders must be tabled before Parliament for consideration and that all the key provisions should be included in the law. MP Frank Habineza said about three years ago, the Minister of Public Service and Labour told lawmakers that the draft ministerial order determining minimum wage was submitted to the Office of the Prime Minister and “promised us that it would be published very soon”. Habineza indicated that when the Committee made a countrywide assessment tour to see how the labour law was being complied with, it held talks with the Ministry, and workers in companies, including mining, factories and hotels, and that the lack of minimum wage was the prevalent issue, with some complaining that they were exploited by their employers through meagre salaries. “You find that a university graduate (bachelor’s degree holder) goes to look for a job, and when taken on, they are given Rwf100, 000 a month, which cannot even suffice to pay house rent for them. Because they badly need employment, they cannot complain, instead, they continue working, say for five years, but they cannot achieve progress as they earn peanuts,” said Habineza, who is also the vice chairperson of the Lower House’s Committee on Social Affairs. He expressed concern that if nothing changes, the parliamentary term is coming to an end this year, without the minimum wage in place. “Delegating most things to ministerial orders is not effective. So, it’s better to put most details in the law,” he said. Again, he said that the bills should be coming from the cabinet having all the important details. The Parliament, she said, should consider both the bills and their implementing orders and ensure that such orders are published in the official gazette within two months after the law has come into force, as stated in the Prime Minister’s instructions. “We have a responsibility in terms of oversight, to know that the laws we passed are enforced,” she said. The minimum wage issue was also exposed last month by some lawmakers during a session of the Lower House Committee on Social Affairs, which was analysing the bill amending the law regulating labour in Rwanda. Responding to the is sue during that session, the Minister of Public Service and Labour, Fanfan Rwanyindo, said that “the Government has not yet taken a decision on minimum wage.” Implications of the minimum wage delay The law regulating labour in Rwanda which was passed by Parliament in 2018, provides that an Order of the Minister in Charge Of Labour determines the minimum wage, based on each category of occupation. Thus far, there is no such minimum wage, which workers’ rights activists have been saying infringes on their rights and can create a loophole for labour and employee exploitation — because employers can pay workers as they please since there is no baseline. In one case, judges at the Supreme Court decided to set a flat amount of compensation – Rwf3,000 a day – that an accident victim should get from insurance companies — in case the victim does not have formal employment (with a written contract and regular pay). Yet, there are even formal employees who earn less than that as a daily wage. And, the case in question set precedence. The President of the Democratic Green Party of Rwanda, Dr. Frank Habineza, who is also a Member of Parliament, has said that the imprisonment of some Rwandan journalists is one of the reasons why the Rwandan media landscape is not free. Dr. Frank Habineza said that he is ready to submit his candidacy in the next Presidential elections. During an interview with UMUSEKE, Dr. Habineza talked about what has been done in the party and what he thinks he would change when he is elected as the President of Rwanda. Habineza said that if he will be trusted, and his party gave him the right to be Presidential candidate, he will campaign for changes, which would make positive impacts to the lives of Rwandans. He said, “We will continue to put a lot of effort in ensuring that Rwanda becomes a full Democratic Country so that every Rwandan can have rights to express his/her opinions and press freedom.” He added that once he becomes a president.. he will make sure that he is putting the media in the agenda for it to work well without obstacles and for it to have the capacity, among others “We will work to get out of poverty, to reach a middle Income society where people are able to get jobs, protect the environment and make sure that we put effort into Security, and look beyond the African continent.” He said Freedom of the press… The recent Rwanda Media Barometer’ published in November 2021 states that freedom of the press is at 93%, that of expression at 86%, independence of the media at 87%, while 94% is a rate of access to information in Rwanda. However, the April 2021 World Press Freedom Index report on press freedom in 180 countries places Rwanda at 156, one of 130 countries that has no Media Freedom. This is why Dr. Frank Habineza finds that there is a need to strengthen the freedom of the media. For Dr. Habineza, the media in Rwanda is struggling to survive which is also one of the reasons why it is not free. He said “One cannot be free if he has no resources. When a person is poor he/she can’t also find the freedoms because Freedom and ability go hands in hands.” “Someone may tell you that you have the right to eat well, but not the ability to buy food. The media may have the right to work, but they don’t have the means to work.” He said Dr. Frank Habineza, in addition to pointing out that there is a lack of financial means in the media, he also found that journalists are afraid to exercise their journalism rights because some have been imprisoned. He said, “There is still an element of fear, you see journalists who are afraid to express their opinions clearly. It depends on the environment we came from or have been in for a while. There are some who look at history and say that there are journalists who have been imprisoned, … all this creates a bad atmosphere, these actions that exist make others afraid.” He said. As we come to the close of the year 2022, the Democratic Green Party of Rwanda [DGPR] wishes to appreciate the Government for the measures which were put in place to combat COVID 19, which proved effective and we were able to resume party activities in the whole country since May. The Democratic Green Party of Rwanda, was able to establish Women and Youth structures at district level in all the 30 dsitricts of the country. We also conducted trainings for those structures on different topics, including; party ideology, gender equality, democracy, elections and environmental protection. DGPR was also able to strengthen existing party structures at district level and members elected new leaders in some districts where it was necessary. In April, this year, the party was also able to send 15 women to Nairobi-Kenya for a bilateral women leaders training facilitated by the Swedish Green Party. Green women were trained on different political topics which included; economy and culture. We are also grateful to the National Consultative Political Organizations Forum in Rwanda [NFPO] which trained 30 of our women from different districts and also 8 youth from Kigali City and Western Province in the Youth Political Leadership Academy, four were girls and four were boys. Other participants came from different Political Parties. Parliamentarians representing the party in both the Chamber of Deputies and the Senate made advocacy on different policies, programs and legislations, on key issues benefitting the population. A lot has been published in the media and we are grateful the media fraternity for keeping the democracy banner raised in Rwanda. We are hopeful that 2023, will equally be a great year, we shall continue: strengthening party structures in the country, capacity building of party members, collaboration with different stakeholders and sectors, implementation of various party strategies, advocating for reforms or changes of government programs and policies in favor of citizens’ better welfare and environmental sustainability. We shall prepare for and participate in the upcoming Parliamentary elections due in August 2023. We shall also continue preparation for the next presidential elections due in August 2024.
